TERMS AND CONDITIONS

1.The term "Website" refers to www.playfish.com and any site owned or operated by Playfish, including, but not limited to, www.petsociety.com.

2. By submitting a photograph of your garden in 'Pet Society' and a photograph of a similar garden (together the "Qualifying Photographs") to the Website, you will be entered into Playfish's 'Pet Society Garden' Competition (the "Competition"). By submitting the Qualifying Photographs you confirm that you agree to these Terms and Conditions.

3. The Competition is open to all who submit Qualifying Photographs to the Website, excluding employees of Playfish and their immediate families, Playfish's agents, or anyone professionally connected with the Competition. If you are using your work computer to access and/or enter the Competition you may need to obtain your employer's permission prior to entering.

4. All entrants aged under 18 must obtain the consent of a parent or legal guardian prior to entry. Playfish reserves the right to ask for evidence of that consent in writing at any time throughout the duration of the Competition, including during and after the selection of winners.

5. NO PURCHASE OF ANY SORT IS NECESSARY TO TAKE PART IN THIS COMPETITION.

6. To enter, your photographs must be Qualifying Photographs as defined at Condition 2 above. Entries which, in the sole opinion of Playfish, do not meet this qualifying criteria will be disqualified. Entrants are asked to take care in participating in this Competition and only carry a camera or take photographs when it is safe to do so.

7. Qualifying Photographs should be uploaded by posting to the Website as high resolution jpg files no more than 1Mb in size.

8. Playfish accepts no responsibility for entries which are lost or corrupted during upload.

9. There is no limit to the number of Qualifying Photographs each person can submit.

10. All Qualifying Photographs submitted to the Website between 00:01 GMT 15 June 2009 (the "Opening Date") and 23:59 GMT 10 July 2009 (the "Closing Date") will be automatically entered into the Competition.

11. Entries must be received by the Closing Date. Late entries will not be accepted.

12. By submitting the Qualifying Photographs, you are confirming that the photographs were taken by you and that you have the express consent of all individuals featured in them for the photographs to be entered into the Competition and in doing so, for them to be posted on the Website and made publicly available. By submitting the Qualifying Photographs which features any individual under the age of 18, you are also confirming that you have the express consent of their parent or legal guardian. Please do not submit any photographs unless you are sure that you have this consent. Please note that should a complaint arise or consent be withdrawn at any time Playfish reserves the right to disqualify the corresponding entry and remove it from the Website.

13. By submitting Qualifying Photographs taken on private property, or of any subject matter in which a third party owns rights, you are confirming that you have the permission of the property or rights owner as appropriate to take the photographs, and for the photographs to be entered into the Competition, posted on the Website and made publicly available. Please do not submit any photographs if you are unsure of whether third party rights subsist or unless you are sure that you have the requisite permissions. Please note that should a complaint arise that any third party rights have been infringed Playfish reserves the right to disqualify the corresponding entry and remove it from the Website.

14. Playfish reserves the right to disqualify and remove from the Website any entry which in its sole opinion it deems to be obscene or offensive in any way.

15. By submitting the Qualifying Photographs you agree that Playfish has an irrevocable and royalty free right to use and reproduce the Qualifying Photographs for the purposes of this Competition and related publicity.

16. By submitting the Qualifying Photographs you warrant that you have full right, power and title to provide the Qualifying Photographs and allow use of such Qualifying Photographs by Playfish in accordance with these Terms and Conditions.

17. By submitting the Qualifying Photographs you agree to indemnify and hold Playfish harmless from any cost, loss, liability or expense (including reasonable legal fees) incurred by Playfish directly or indirectly as a result of any claim, demand, or litigation brought against Playfish by any third party due to or arising out of such Qualifying Photographs you submit to the Website.

18. 18. A panel of judges (selected by Playfish) will select 3 winners from the entries received prior to the Closing Date. Photographs will be judged according to their originality, appropriateness and quality of photography. Prizes will be awarded in the following order:

2'nd Prize: 50k Pet Society Coins (Facebook)
3'rd Prize: 25k Pet Society Coins (Facebook)

19. The judges' decision is final and binding and no correspondence will be entered into.

20. No cash or other prize alternatives are available.

21. Playfish reserves the right to substitute the prizes for any prize(s) of an equal or greater value in the event of circumstances beyond its control.

22. Winners will be notified by email within 3 days of the Closing Date. A list of winners will be published on the Website on 13 July 2009 and remain available until 27 July 2009.

23. To claim a prize, proof of age, identity and where appropriate parent or legal guardian consent may be required.

24. The prize winners may be required to participate in publicity and promotional activities.

25. Playfish reserves the right to amend these Terms and Conditions and/or to cancel the Competition at its sole discretion.

26. These Terms and Conditions shall be governed by and construed in accordance with English law. You hereby submit to and agree that the sole jurisdiction and venue for any actions that may arise under or in relation to the subject matter hereof shall be the English courts.

The promoter of the Competition is Playfish Limited, whose registered office is at 58-60 Berners Street, London W1T 3JS, United Kingdom and whose principal place of business is at 125 Kensington High Street, London W8 5SF, United Kingdom.

You acknowledge and agree that all characters created and items acquired and developed as a result of game play are part of the applicable game Software and related Services and are the sole property of Playfish and/or its licensors. You acknowledge that: (i) such Software and related Services permit access to Content that is protected by copyrights, trademarks, and other proprietary rights owned by Playfish, and/or its licensors (collectively, "Rights "), and (ii) these Rights are valid and protected in all media existing now or later developed, and (iii) except as is explicitly provided otherwise, your use of Content shall be governed by the copyright laws of England and other applicable laws. You agree that you may upload or otherwise transmit on or through the Service only Content that is not subject to any third-party Rights, or Content in which any holder of Rights has given express authorization for distribution on the Service. If and to the extent you are deemed to have retained, under applicable law, any right, title or interest in or to any portion of the Content, you hereby transfer, grant, convey, assign and relinquish solely and exclusively to Playfish and/or its licensors all of your right, title and interest in and to the Content, without reservation and without additional consideration, under applicable patent, copyright, trade secret, trademark and other similar laws or rights, in perpetuity, and in the alternative to the extent such assignment is ineffective under applicable law, you hereby grant to Playfish and/or its licensors, their successors and assigns, the sole and exclusive, irrevocable, sublicensable, transferable, worldwide, paid-up license to reproduce, fix, adapt, modify, translate, reformat, create derivative works from, manufacture, introduce into circulation, publish, distribute, sell, license, sublicense, transfer, rent, lease, transmit, publicly display, publicly perform, or provide access to electronically, broadcast, communicate to the public by telecommunication, display, perform, enter into computer memory, and use and practice the Content all modified and derivative works thereof, all portions and copies thereof in any form, all inventions, designs, and marks embodied therein, and all patent, copyright, trade secret, trademark and other intellectual property rights thereto, and/or to incorporate the same in other works in any form, media, or technology now known or later developed. To the extent permitted by applicable laws, you hereby waive any moral rights you may have in the Content.
